Welcome to the Broken Plate mobile application ("App"), operated by Broken Plate Kitchen ("Broken Plate," "we," "our," or "us"). By accessing or using the App, you agree to these Terms and Conditions.

1. Acceptance of Terms

By creating an account, accessing, or using the Broken Plate App, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the App.

2. Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent that you meet this requirement.

3. Account Registration

Users may be required to create an account to access certain features.

You agree to:

  • Provide accurate information.

  • Maintain the security of your account credentials.

  • Notify us of any unauthorized use of your account.

You are responsible for all activity occurring under your account.

4. Loyalty Program and Rewards

The App may offer loyalty rewards, birthday rewards, anniversary rewards, promotional offers, and other member benefits.

Broken Plate reserves the right to:

  • Modify or discontinue any reward or promotion.

  • Limit rewards to one per eligible user.

  • Refuse rewards that are obtained through misuse or fraud.

  • Establish expiration dates and redemption requirements.

Rewards have no cash value unless expressly stated otherwise.

5. Reservations, Ordering, and Gift Cards

The App may provide access to third-party reservation systems, online ordering platforms, and gift card services.

Broken Plate is not responsible for service interruptions, pricing changes, or errors caused by third-party providers.

6. Acceptable Use

You agree not to:

  • Use the App for unlawful purposes.

  • Attempt to gain unauthorized access to the App or its systems.

  • Interfere with the operation or security of the App.

  • Create fraudulent accounts or misuse promotions.

7. Intellectual Property

All content, logos, branding, graphics, text, and software associated with Broken Plate Kitchen are owned by or licensed to Broken Plate and are protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, or modify any content without written permission.

8. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis.

Broken Plate makes no warranties regarding:

  • Availability of the App

  • Accuracy of content

  • Continuous or error-free operation

  • Availability of rewards or promotions

9. Limitation of Liability

To the fullest extent permitted by law, Broken Plate Kitchen shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of the App.

10. Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms and Conditions or misuse the App.

11. Changes to Terms

We may update these Terms and Conditions at any time. Continued use of the App after changes are posted constitutes acceptance of the revised Terms.

12. Governing Law

These Terms and Conditions shall be governed by the laws of the State of North Carolina, without regard to conflict of law principles.
